Some of the earliest patents on OS9, if here were any, most likely expired 
somewhere around 1995 to 1998 time frame. For Microsoft to patent something 
that was prior knowledge they would have to expand on those original patents. 
They would have to include something that was not covered under any previous 
patents. This is not all that uncommon or in some cases very difficult to do. 

It is not real common where a company totally covers a lot of bases and makes it 
such that a patent cannot be circuvented or expanded on.
