Yes, but what if the buyer gets the item, damages it and then claims that it was never working?

How does the seller protect himself against this?

With every silver lining comes the possibility of a rotten core.

Mark items with ultraviolet ink and take a picture.  Not perfect, but it 
helps....

eBay will allow a return for the smallest of reasons.
