Maybe it is, and I guess for the hobby level of production, it would be 
too low to even worry Cadsoft, or even make it worth them going after you.

However to get the hobby license I had to sign, an agreement and send it 
to them (scan -> email) saying that I would not use it commercially, 
which I would imagine is legally binding if they caught you doing it, 
but IANAL.
